Terms of Service

G&D SHIPPING SERVICES JA

TERMS & CONDITIONS OF SERVICE

Effective Date: January 14 , 2025

By using the services of G&D Shipping Services JA (“G&D”, “we”, “our”, “us”), the customer (“Client”, “Shipper”, “Consignee”) agrees to the following Terms & Conditions:

1. Acceptance of Terms

By tendering goods to G&D Shipping Services JA for air or sea freight, the customer agrees to be bound by these Terms & Conditions. These terms apply to all shipments handled by G&D unless otherwise agreed in writing.

2. Limitation of Liability

G&D Shipping Services JA is not responsible or liable for:

  • Damaged goods

  • Missing items

  • Lost packages

  • Partial shortages

  • Manufacturer defects

  • Improper packaging by the shipper

  • Leakage, spoilage, rust, breakage, or deterioration

  • Delays caused by Customs, airlines, shipping lines, ports, weather, or force majeure events

All shipments are handled at the customer’s sole risk.

G&D acts solely as a freight forwarder and facilitator between carriers, airlines, shipping lines, and Jamaica Customs.

3. Packaging Responsibility

Customers are responsible for ensuring that all goods are:

  • Properly packaged

  • Securely sealed

  • Suitable for international transportation

G&D is not liable for damage resulting from inadequate packaging.

4. Insurance

Unless insurance is specifically requested and paid for in advance, shipments are not insured by G&D Shipping Services JA.

Customers are strongly encouraged to obtain shipping insurance for high-value items.

5. Customs & Duties

  • All shipments are subject to inspection by Jamaica Customs.

  • Any item valued over USD $100 may be subject to duties, taxes, and government charges.

  • Customers are responsible for providing accurate invoices and descriptions.

  • G&D is not responsible for additional charges imposed by Customs.

Failure to provide invoices may result in estimated valuation by Customs.

6. Prohibited & Restricted Items

Customers must not ship:

  • Illegal substances

  • Firearms or ammunition (unless legally declared and approved)

  • Explosives or hazardous materials

  • Perishable goods without prior approval

  • Counterfeit or prohibited goods

Any prohibited item discovered may be surrendered to authorities without notice.

7. Delivery & Collection

  • Customers must present valid identification when collecting packages.

  • Goods left uncollected for more than 14 days may incur storage fees.

  • Uncollected goods after 30 days may be disposed of at G&D’s discretion.

8. Claims

All claims must be made in writing within 24–48 hours of collection.

Failure to notify G&D within this timeframe constitutes acceptance of goods in good condition.

9. Payment Terms

All shipping charges, customs fees, service charges, and storage fees must be paid in full before release of goods.

G&D reserves the right to refuse release of cargo until full payment is received.

10. Force Majeure

G&D shall not be held liable for delays, loss, or damage caused by:

  • Natural disasters

  • Hurricanes

  • Port congestion

  • Government actions

  • Strikes

  • Airline or shipping line delays

  • Civil unrest

11. Right to Refuse Service

G&D Shipping Services JA reserves the right to refuse any shipment at its discretion.

12. Amendments

G&D reserves the right to update or modify these Terms & Conditions at any time without prior notice.

13. Governing Law

These Terms & Conditions are governed by the laws of Jamaica.
